Terms of Service

By accessing or using GEXBoard ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

1. Service Description

GEXBoard is a market structure analytics platform that provides Gamma Exposure (GEX) data, options positioning metrics, and related analytics for informational purposes only. The Service does not provide financial advice, trading signals, or investment recommendations of any kind.

2. Beta Pricing & Rate Lock

GEXBoard is currently in a beta period that ends on July 1, 2026. Subscribers who join during this period are locked in at their beta rate for as long as their subscription remains active and in good standing.

  • Starter: $19/mo beta → $39/mo standard after July 1, 2026
  • Pro: $39/mo beta → $79/mo standard after July 1, 2026
  • Trader: $79/mo beta → $149/mo standard after July 1, 2026

The beta rate is locked to the subscriber's account for as long as the subscription remains active. If a subscription lapses or is cancelled, the following rules apply:

  • The subscriber has 30 days from the cancellation date to reactivate and recover their locked beta rate, provided the beta period has not yet ended.
  • After 30 days from cancellation, or if the beta period has ended, resubscription will be billed at the then-current standard rate.
  • Beta rates are non-transferable and apply only to the plan tier originally purchased.

2b. Beta Pricing & Price Lock Guarantee

Effective date: April 9, 2026

1. Current beta pricing (active until July 1, 2026):

  • Starter: $9/mo (production) / $19/mo (new platform)
  • Pro: $29/mo (production) / $39/mo (new platform)
  • Trader: $79/mo (both platforms)

2. Standard pricing (effective July 1, 2026):

  • Starter: $39/mo
  • Pro: $79/mo
  • Trader: $149/mo

3. Price Lock Guarantee:

Subscribers who maintain an active subscription lock their rate permanently at the price in effect at the time of their initial subscription. This rate will not increase for as long as the subscription remains active and uninterrupted.

4. Price lock applies to:

  • All current active subscribers
  • New subscribers who subscribe before July 1, 2026
  • Subscribers on the current production platform (gexboard.com) who subscribe before the new platform launches

5. Price lock is forfeited if:

  • The subscription is cancelled or lapses
  • Payment fails and is not resolved within the grace period (30 days)
  • The subscriber voluntarily downgrades and later upgrades again

6. New platform launch:

Upon launch of the new GEXBoard platform, all existing subscribers retain their locked price regardless of platform version. New subscribers after launch will be subject to the pricing in effect at that time.

GEXBoard reserves the right to modify standard pricing at any time. Price lock guarantees apply only to existing active subscribers as described above.

3. Service Provided "As Is"

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or accurate at all times.

4. Not a Registered Investment Advisor

GEXBoard is not a registered investment advisor, broker-dealer, or financial planner. Nothing on the platform constitutes financial advice. All data and analytics are provided for informational and educational purposes only. You should consult a qualified financial professional before making any investment decisions.

5. Data Accuracy and Delays

Market data displayed on GEXBoard may be delayed and may contain errors or inaccuracies. We make no representations as to the accuracy, completeness, or timeliness of any data. Options and market data is sourced from licensed third-party market data providers. GEXBoard is not responsible for errors, interruptions, or inaccuracies originating from those sources.

6. Modifications to Pricing, Features, or Terms

GEXBoard reserves the right to modify pricing, features, or these Terms at any time. For existing subscribers, material changes to pricing or terms will be communicated with at least 30 days notice via email. Continued use of the Service after the effective date of any change constitutes acceptance of the new terms.

7. Refund Policy and Auto-Renewal

7.1 Auto-Renewal

Your subscription automatically renews at the end of each billing period (monthly or annual, as selected at signup) at the rate locked to your account. By subscribing, you authorize GEXBoard, via Stripe, to charge your payment method on file on each renewal date until you cancel. This auto-renewal is the default behavior of all subscription plans and is not optional while the subscription is active.

7.2 How to Cancel

You may cancel your subscription at any time, effective at the end of the current billing period, by clicking the "Cancel" button on your /account page. The button opens the Stripe-hosted Customer Portal and processes the cancellation directly through your payment processor. This option is always available to active subscribers and requires no contact with support, no email request, no waiting period, and no justification. You do not need our permission to cancel.

7.3 No Refunds

All subscription fees are non-refundable. We do not offer refunds, credits, or proration for partial months, for unused renewal periods, for forgotten cancellations, for changes in personal circumstances, or for disputes about subjective intent. If you cancel before the end of your current billing period, you retain full access to the Service until that period ends, but no portion of already-paid fees is returned.

7.4 Intent Is Not Determinable Retroactively

If you are billed for a renewal and did not use the platform during that renewed period, this is not grounds for a refund. We have no means of verifying retroactively whether a given renewal was intended or accidental, and we do not investigate disputes of this nature. The continuous availability of the in-app cancellation option described in Section 7.2 discharges our obligation to provide an accessible cancellation mechanism. Responsibility to cancel before the renewal date rests entirely with the subscriber.

7.5 Goodwill Refunds Are Discretionary

We may at our sole discretion issue partial or full refunds outside this policy as a goodwill gesture. Such refunds, if issued, do not establish a pattern, precedent, or entitlement, and confer no expectation of future similar treatment. A refund issued in one case carries no implication that a similar refund will be issued in any other case, including for the same subscriber under similar circumstances.

7.6 Material Service Defects

If you believe you were unable to use the Service due to a material defect on our side — such as an extended platform outage, a billing system error attributable to us, or an account access lock caused by our infrastructure — contact contact@gexboard.com within 30 days of the affected period with a description of what occurred. We will investigate and resolve appropriately, which may include a refund, credit, or service-time extension at our discretion. Disputes raised after 30 days, or unrelated to a material defect on our side, fall under Sections 7.3 and 7.4.

8. Eligibility

You must be at least 18 years of age to subscribe to GEXBoard. By subscribing, you represent and warrant that you meet this requirement.

9. Acceptable Use

You agree not to use the Service for any unlawful purpose, to reverse engineer or copy any part of the platform, to resell or redistribute GEXBoard data without written permission, or to attempt to disrupt or damage the Service in any way.

9.1 Programmatic / Automated Access Restriction

GEXBoard provides two distinct surfaces for accessing its data:

  • Browser (cookie-authenticated) surface — the dashboards at /radar, /heatmap, /greeks, /premium-map, etc., and the supporting JSON endpoints they consume. These are intended for human browser use only.
  • API Addon (Bearer-authenticated) surface — the /v1/* endpoints, available exclusively to subscribers who have purchased the API Addon. See /api-docs and the API Terms for pricing and full terms.

Programmatic, automated, or scripted access to the cookie-authenticated surface is strictly prohibited. This includes, without limitation: scripts using the HTTP libraries requests, httpx, aiohttp, urllib, curl, wget, scrapy, okhttp, headless browsers driven for the purpose of bulk data extraction, RPA tools, third-party scrapers, and any automated process that reuses a session cookie to call dashboard data endpoints at scale.

Reusing a session cookie outside an interactive browser session — including copying it into a script, sharing it with another person, or using it from automated infrastructure — is a violation of these Terms.

Bulk extraction is prohibited regardless of authentication method used. Subscribers with the API Addon are bound by separate per-endpoint rate limits and bulk-extraction restrictions described in the API Terms. Use that does not match an ordinary individual research workflow may be terminated even on the API Addon path.

We reserve the right to investigate, log, rate-limit, suspend, terminate, refuse refund, and ban accounts and IPs that violate this section, at our sole discretion and without prior notice. We may report violators to their internet service provider and to public abuse databases where appropriate.

9.2 Enforcement Actions on Violation

By using the Service you acknowledge and consent that, upon a determination by us in our sole discretion that you have violated Section 9.1 (or attempted to circumvent its restrictions), we may take any or all of the following actions without prior notice and without entitlement to refund:

  • Immediate session termination and account suspension — your session cookies are invalidated and your account is locked. Pre-paid periods are not refunded.
  • Account termination with no re-subscription — your email address, Stripe customer identifier, and payment methods are added to our internal blocklist. Future signup attempts under these identifiers are rejected automatically.
  • IP address blocking — at the application layer, at the web server layer, and (where applicable) reported to network providers and public abuse databases including AbuseIPDB and SORBS.
  • Payment fraud report to Stripe — your customer record and payment methods are flagged via Stripe Radar as fraud-risk. This designation is visible to all other businesses worldwide that use Stripe for payments. Recovery of clean payment-method standing across the Stripe network is not guaranteed and is solely at Stripe's discretion.
  • ISP and law-enforcement reporting — we may file formal abuse complaints with your internet service provider (identified via WHOIS records of the originating IP) and, where the conduct may constitute unauthorized use of computer systems under applicable law, with national cybercrime authorities.
  • Public listing on industry abuse databases — your IP address may be submitted to AbuseIPDB and equivalent public reputation services with a description of the violation. Inclusion in these databases is acted upon automatically by firewalls and anti-bot services operated by third parties globally.
  • Civil and criminal recourse — you remain liable for any direct and consequential damages caused by the violation, including but not limited to the cost of investigation, server resources consumed, lost revenue from unsold API Addon subscriptions, and reputational damages. We reserve the right to pursue all available civil and criminal remedies in any jurisdiction where the violator may be reached.

These actions are cumulative, not exclusive. We may take any subset, all of them, or additional measures permitted by law. Acceptance of these Terms constitutes prior, informed consent to each of the above measures in the event of violation. No notice, opportunity to cure, or grace period is required.

In plain language: scraping our cookie-authenticated surface, reusing a session cookie outside a browser, or otherwise circumventing the API Addon path to access bulk data is a hard violation. We see it. We act on it. Resubscribing under a new email or new payment method to continue the same behavior is itself a separate violation that we treat as fraud.

10. Limitation of Liability

In no event shall GEXBoard or its operators be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or trading losses, arising from your use of or inability to use the Service, even if advised of the possibility of such damages.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Mexico, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of competent jurisdiction in Mexico.
